Terms of Service Summary

Section 3: Data Contribution License

Subscriber grants Apex an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, transfer, and distribute any data submitted through the Platform. This license survives termination of subscription.

Section 4: Third-Party Intelligence

Subscriber acknowledges that Apex aggregates data from multiple sources, including other Subscribers, public records, and "Market Observers." Apex makes no representations regarding the accuracy, completeness, or truthfulness of third-party contributions. Subscriber waives all claims against Apex for damages arising from reliance on aggregated intelligence.

Section 14.3: Commercial Intelligence Rights

Subscriber expressly acknowledges that Apex maintains a proprietary database of commercial intelligence derived from Subscriber contributions. Such intelligence may be licensed to third parties, including financial institutions, procurement departments, and strategic partners. Subscriber has no right to inspect, contest, or remove third-party contributions regarding Subscriber's business.
